CommuterDirect.com Terms and Conditions
The creation of an account on CommuterDirect.com constitutes the "Contract" between the CommuterDirect.com customer, whether an individual, company or organization whose name appears on the CommuterDirect.com account (hereinafter referred to as "you") and CommuterDirect.com and its operator The Convention Store, Inc. (hereinafter collectively referred to as "CommuterDirect.com"). By creating a CommuterDirect.com account, you agree to be, and hereby are, bound by the terms and conditions set forth below, which are made part of and incorporated into the Contract.
- Your Account: You agree to provide accurate and complete information in your account, and to update that information as necessary on a timely basis. You are responsible for maintaining the confidentiality of your login credentials (user ID and password), and CommuterDirect.com is not responsible for any acts or omissions by you in connection with your creation and maintenance of your account. You must notify CommuterDirect.com immediately if you suspect that your account has been compromised in any way.
- Accuracy of Information: CommuterDirect.com makes every effort to maintain accurate and current information on its website, but makes no warranty, express or implied, about its accuracy or applicability. CommuterDirect.com may provide informational links to external websites but CommuterDirect.com is not responsible for the content nor the security of external websites.
- Privacy and Data Security: Our privacy policy describes how CommuterDirect.com collects, uses, and protects your data. CommuterDirect.com will make every effort to comply with industry best practices to protect customer information. You are responsible for keeping the software and hardware used to access CommuterDirect.com up to date and free of malware in order to keep your data secure in transmission and storage.
- Acceptable Use and Intellectual Property: You agree to interact with the CommuterDirect.com website only using the provided online forms and not to attempt to bypass form controls or scripts. You agree that you will not use any graphics, editorial content, software, or scripts contained on the CommuterDirect.com site for any purpose other than use of the CommuterDirect.com service.
- Payment for Goods and Services: You authorize CommuterDirect.com to charge the payment methods (including but not necessarily limited to personal credit cards and employer-provided transit benefit accounts) that you specify for the purchase of goods and services, and you affirm that you are the rightful owner of such payment methods (or, if you are acting on behalf of a company or organization, that you are authorized to use them). If you elect to save payment methods in your account for future use, you authorize CommuterDirect.com to save and transmit the payment information securely and to use it for no purposes other than payment for the goods and services you have ordered on the website. If you instruct CommuterDirect.com to use your employer-provided transit benefits to pay for all or part of your order, you are responsible for paying any amount not covered by the funds received from your employer.
- Recurring Orders: Placing a recurring order authorizes CommuterDirect.com to process your order and collect payment for it on a monthly basis unless or until the order is suspended or canceled at your direction. CommuterDirect.com is not responsible for any problems that may result if a recurring order is not canceled or suspended on a timely basis..
- Electronic SmartBenefits (ESBs): The use of Electronic SmartBenefits (ESBs) to pay for fare media orders both on CommuterDirect.com and in-person at the Commuter Stores or the MARC Ticket Vending Machines (TVMs) involves the use of funds that were provided to the end user by their employer via the WMATA SmartBenefits program. These funds may be provided as a direct, employer-funded benefit to you, or they may be provided as a pre-tax payroll deduction by your employer. In both of these cases, the transactions are governed by the Internal Revenue Code. The transactions are further governed by WMATA's terms and conditions for its SmartBenefits program, as agreed to by your employer. Once the ESB funds are provided to either CommuterDirect.com or the Commuter Stores/TVMs, these funds become non-refundable to the employer/employee and are designated for transit purchases only. These transit benefits will be forfeited by you if not used within thirty six (36) months of being deposited and will be removed from the account. Under no circumstances shall any funds representing unused transit benefits be refunded to an employee to whom such benefits were intended. Employees should direct any inquiries or requests regarding revocation of election for such benefits or refunds for such benefits to their respective employers. Funds provided on behalf of federal agencies to be used by federal employees are subject to a monthly "use or lose" scenario. Funds are made available to federal employees on the 22nd day of each month and are intended to be used to purchase tickets and/or passes for the following calendar month's commute related travel to and from your place of federal employment. Each month on the 22nd, any funds that were previously provided into the federal employee's account will be removed and designated for return to the federal government.

Returns and Refunds: By placing an order on CommuterDirect.com, you
agree to the return and refund policies of the transit system for which you
have purchased fares, including Metro Products. Return and refund policies,
which are subject to change by the transit providers, are currently as
follows:
Virginia Railway Express - VRE: Single-Ride and Ten-Trip Tickets expire six months after first validation or one year after purchase, and are nonrefundable. Seven-Day Tickets expire five days after first validation or one year from purchase, and are nonrefundable. Monthly Tickets are valid for one calendar month and are refundable under the following conditions:
- Return postmarked prior to effective month: 100% refund
- Return postmarked 1st through 10th of effective month: Two Single-Ride full fares for the applicable zone pairing will be deducted from refund for each service day prior to the post mark on the returned ticket.
- Return postmarked after the 10th of the effective month: 0% refund
- The $116 Metrorail portion of a Transit Link card is nonrefundable after the first of the month.
- The $116 portion of the Transit Link card is nonrefundable once it has been used in the Metro system.
- If your VRE TLC ticket becomes damaged, ONLY WMATA can provide you with a substitute pass. These passes are ONLY available at the Metro sales office.
MARC Train Service: One-Way tickets expire 6 months from date of purchase and are nonrefundable. Weekly tickets are valid for one calendar week and are refundable if the return postmark is dated no later than 11:59 p.m. the Friday prior to the effective week. Monthly tickets are valid for one calendar month and are refundable, based on the return postmark date, as follows:
- Postmarked prior to effective month: 100% refund
- Postmarked 1st through 5th of effective month: 75% refund
- Postmarked 6th through 10th of effective month: 50% refund
- Postmarked after the 10th of effective month: 0% refund
- The Metro fare portion of the Transit Link card ($117) is non-refundable once it has been used in the Metro system.
- If your MARC TLC ticket becomes damaged, ONLY WMATA can provide you with a substitute pass. These passes are ONLY available at the Metro sales office.
MTA Commuter Bus: Ten-Trip tickets expire 6 months after date of purchase and are non-refundable. Monthly tickets are valid for one calendar month and are refundable, based on the return postmark date, as follows:
- Postmarked prior to effective month: 100% refund
- Postmarked 1st through 5th of effective month: 75% refund
- Postmarked 6th through 10th of effective month: 50% refund
- Postmarked after the 10th of effective month: 0% refund
- The Metro fare portion of the Transit Link card ($179) is non-refundable once it has been used in the Metro system.
- If your TLC ticket becomes damaged, ONLY WMATA can provide you with a substitute pass. These passes are ONLY available at the Metro sales office.
- Lost, Stolen, or Missing Shipments: CommuterDirect.com is not responsible for lost, missing, or stolen shipments delivered with a non-traceable shipping method such as first class mail. If you select a traceable shipping method, CommuterDirect.com is responsible for a replacement or refund but is not liable for any other monetary or non-monetary loss incurred by you.
- Limitation of Responsibility as Ticket Agent: CommuterDirect.com is not responsible for the performance of the transit systems for which it acts as a sales agent.
- Indemnification: To the fullest extent permitted by law, you shall indemnify and hold harmless CommuterDirect.com and its agents and employees from and against claims, damages, losses and expenses, including but not limited to attorney's fees, arising out of or resulting from its performance of services, but only to the extent caused by your negligent, unlawful and/or actionable acts or omissions, regardless of whether or not such a claim, damage, loss or expense is caused in part by a party indemnified hereunder.
- Governing Legal Authority: The Contract, including these Terms and Conditions all products and services provided under it, and any disputes arising in connection with it shall be governed by the laws of the Commonwealth of Virginia.
- Dispute Resolution: Any claim pertaining to the poor or unprofessional quality of CommuterDirect.com's services rendered must be made in writing to CommuterDirect.com within ten business days after the events giving rise to the claim. Unless you notify CommuterDirect.com in writing within ten business days, you shall be deemed to have accepted CommuterDirect.com's services without qualification.
- Waiver of Jury Trial: The Client hereby waives a trial by jury arising out of the Contract and these Terms and Conditions.
- Waiver and Release: You fully waive and release CommuterDirect.com, its agents and contractors, from any and all claims, demands and damages of every kind and nature, whether known or unknown, suspected or unsuspected, disclosed or undisclosed, arising out of or in any way connected with your use of CommuterDirect.com and any dispute you have or claim to have against CommuterDirect.com or its agents or contractors.
- CommuterDirect.com does not promise that CommuterDirect.com will be error-free, uninterrupted or that it will provide specific results from use of the site or any content, search or link on it, the site and its content are delivered on an "as is" and "as-available" basis. CommuterDirect.com cannot ensure that files you download from the site will be free of viruses or contamination or destructive features. CommuterDirect.com disclaims all warranties, express or implied, including also any implied warranties of merchantability and fitness for a particular purpose. CommuterDirect.com will not be liable for any damages of any kind arising from the use of its site, including without limitation, direct, indirect, incidental, or punitive, and consequential damages or for travel expenses, lost profits, lost revenues or lost business opportunities. CommuterDirect.com makes no guarantee of any specific result from use of this site or use of CommuterDirect.com services.
- Term of Contract: Your Contract, including these Terms and Conditions, will remain in effect until terminated by either party. CommuterDirect.com reserves the right to terminate the Contract at any time if you are in violation of its terms, including but not limited to nonpayment for goods provided. You may terminate this Contract by deleting your account, but only if you do not have any outstanding unpaid payment obligations. Your obligations under this Contract remain in effect if any payments are outstanding unless CommuterDirect.com consents to termination of the Contract.
- Severability: If any term or provision of the Contract or these Terms and Conditions is invalid, illegal or unenforceable in any jurisdiction, such invalidity, illegality or unenforceability shall not affect any other term or provision of the Contract or these Terms and Conditions or invalidate or render unenforceable such term or provision in any other jurisdiction.
